Welcome to Roots Archive (“Platform”), owned and operated by Texmith Infotech (“we”, “our”, “us”).

By accessing or using this Platform, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Platform.

1. DEFINITIONS

  • Platform: The Web Application “Roots Archive”
  • User: Any individual accessing or using the Platform
  • Family Data: Information including name, date of birth (DOB), date of death (DOD), relationships, health details, and other personal records
  • Member: A person added/invited to the Platform

2. ELIGIBILITY

You must:

  • Be at least have a Active Mail account or an Active personal mobile number, or
  • Be at least 18 years of age, or
  • Use the Platform under supervision of a legal guardian

By using the Platform, you confirm that you have the legal capacity to enter into this agreement.

3. USER ACCOUNT & REGISTRATION

  • You agree to provide accurate and complete information
  • You are responsible for maintaining confidentiality of your account
  • You are responsible for all activities under your account

We reserve the right to suspend or terminate accounts with false or misleading information.

4. PLATFORM SERVICES

The Platform provides:

  • Family tree creation and management
  • Storage of family-related data
  • Notifications for DOB, DOD, Anniversaries
  • Communication between connected family members

We may update, modify, or discontinue features at any time without prior notice.

5. USER RESPONSIBILITIES

You agree that you will:

  • Provide accurate and lawful information
  • Add only those individuals for whom you have consent (where applicable)
  • Respect privacy and dignity of other members
  • Not upload false, defamatory, or harmful content

You shall not:

  • Use the Platform for illegal activities
  • Impersonate any person
  • Misuse personal data of others

6. CONSENT FOR ADDING FAMILY MEMBERS

By adding any person to the Platform:

  • You confirm that you have obtained necessary consent (where required)
  • You understand that invitations/notifications may be sent to them

We are not responsible for disputes arising from adding individuals without consent.

7. DATA OWNERSHIP & USAGE

  • You retain ownership of the data you provide
  • You grant us a limited license to store, process, and display such data for Platform functionality

We do not sell personal data.

8. PRIVACY

Your use of the Platform is also governed by our Privacy Policy.

All data is intended to be visible only within your connected family network, subject to user permissions and acceptance.

9. CONNECTION & ACCESS CONTROL

  • Family members can connect only upon acceptance of requests
  • Access to personal data is restricted based on relationships and permissions
  • We do not guarantee complete privacy due to user-controlled sharing

10. COMMUNICATIONS

By using the Platform, you agree to receive:

  • Notifications (DOB, DOD, anniversaries)
  • Invitations and connection requests
  • Alerts via email, SMS, or messaging services

You may opt out of non-essential communications where applicable.

11. TERMINATION

We reserve the right to:

  • Suspend or terminate your account
  • Remove content
  • Restrict access

If you:

  • Violate these Terms
  • Provide false or harmful data
  • Misuse the Platform

You may also delete your account at any time.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

We shall not be liable for:

  • Loss of data
  • Unauthorized access due to user negligence
  • Emotional distress or family disputes
  • Any indirect or consequential damages

Use of the Platform is at your own risk.

13. INTELLECTUAL PROPERTY

  • All Platform content, design, branding, and technology are our property
  • You may not copy, modify, or distribute without permission

14. THIRD-PARTY SERVICES

The Platform may rely on third-party services (SMS, email providers).

We are not responsible for:

  • Delivery failures
  • Delays
